Writing a pallet clause into a hauling contract

A hauling contract can require pallets to be collected separately, name acceptable destinations (reuse, repair, grinding), ban landfilling, exclude pooled pallets, and require monthly counts. Put it in at renewal, when you have leverage, and ask for the destination in writing so your diversion figure is documented.

Points to cover

  • Separate collection: pallets never collected with mixed waste.
  • Destinations: reuse or repair first, then grinding; landfill only with written approval.
  • Pooled pallets: the hauler doesn't take them; the site returns them to their owners.
  • Records: monthly counts or tons by destination, with the receiving facility named.
  • State law: where a state bans pallets or wood from landfills, compliance is the hauler's obligation too.

Sample wording

'Contractor shall collect wood pallets separately from other waste and deliver them to a reuse, repair or wood recycling facility. Contractor shall not landfill pallets without Customer's prior written approval. Contractor shall not collect pallets marked as the property of a third party. Contractor shall report monthly the number or weight of pallets collected and the facility that received them.'

This is sample language, not legal advice. Have your own counsel adapt it.

Why the records matter

Without destination records, a diversion claim rests on the hauler's say-so. See documenting pallet diversion.
